Today (7 July 2026), I submitted by email a formal complaint and request for urgent intervention entitled “Complaint Requesting an Urgent Independent Investigation into the Negombo Prison Incident, Alleged Violations of Fundamental Human Rights, and the Failure of the State to Protect Persons Deprived of Liberty” concerning the recent Negombo Prison incident and subsequent reports relating to the safety, lives and fundamental rights of persons in State custody.

The communication respectfully requests urgent international attention, the protection of persons in State custody, the preservation of evidence, and an independent, impartial and transparent investigation consistent with Sri Lanka’s Constitution and its obligations under international human rights law.
This communication is made in good faith and is not intended to undermine the sovereignty of Sri Lanka or the role of its domestic institutions. Its sole purpose is to support accountability, the rule of law, the protection of human dignity and the prevention of further loss of life.

2026 ජූලි 6 වන දින, මීගමුව බන්ධනාගාරයේ සිදුවීම සම්බන්ධයෙන් හදිසි, ස්වාධීන, අපක්ෂපාතී සහ විනිවිදභාවයෙන් යුතු විමර්ශනයක් පවත්වන ලෙස ඉල්ලා, ශ්රී ලංකා මානව හිමිකම් කොමිෂන් සභාව වෙත මා විසින් නිල පැමිණිල්ලක් ඉදිරිපත් කරන ලදී. ප්රසිද්ධියේ පළ වූ වාර්තා අනුව, එම සිද්ධියෙන් රාජ්ය භාරයේ සිටි පුද්ගලයන් සහ බන්ධනාගාර නිලධාරීන් අතර මරණ කිහිපයක් සහ බරපතළ තුවාල සිදුවී ඇති බව සඳහන් වේ.
මෙම සිද්ධීන් පිළිබඳ විමර්ශනය කිරීමේ මූලික වගකීම ශ්රී ලංකා රජයට සහ එහි බලයලත් දේශීය ආයතනවලට පැවරී ඇති බව මා සම්පූර්ණයෙන්ම පිළිගනිමි. එහෙත්, ඉන් අනතුරුව රාජ්ය භාරයේ සිටින පුද්ගලයන් සම්බන්ධයෙන් තවත් බරපතළ මානව හිමිකම් උල්ලංඝන සිදුවී ඇති බවට වාර්තා පළවීම හේතුවෙන්, මෙම තොරතුරු එක්සත් ජාතීන්ගේ අවධානයට යොමු කිරීම අවශ්ය බව මා විශ්වාස කරමි.
අද සවස බන්ධනාගාර රැඳවියන්ගේ අයිතිවාසිකම් ආරක්ෂා කිරීමේ කමිටුව (Committee for Protecting Rights of Prisoners) වෙතින් ලද තොරතුරු අනුව, මීගමුව බන්ධනාගාරයේ සිට වැලිකඩ බන්ධනාගාරය වෙත මාරු කළ රැඳවියන් විසි එක් දෙනෙකු නිල භාරය යටතේ ප්රවාහනය කරන අතරතුර බරපතළ ලෙස ශාරීරික පහරදීම්වලට ලක් වූ බවට චෝදනා කර ඇත. එම තොරතුරු අනුව, ඔවුන් වැලිකඩ බන්ධනාගාර රෝහල වෙත ගෙන එන විට බරපතළ තුවාල සහිතව සිට ඇති අතර, අවම වශයෙන් එක් රැඳවියෙකු වෙඩි වැදීමකට ලක්ව ඇති බවත්, තුවාල ලැබූ රැඳවියන්ගෙන් එක් අයෙකු පසුව මියගොස් ඇති බවත් සඳහන් වේ.
වඩාත්ම බරපතළ කරුණ වන්නේ, එම මරණය සියදිවි නසා ගැනීමක් ලෙස පෙන්වා දීම සඳහා එහි සැබෑ තත්ත්වය වසන් කිරීමට උත්සාහයක් ගෙන ඇති බවට චෝදනා ඉදිරිපත් වීමයි. මෙම චෝදනා ස්වාධීනව සත්යාපනය කිරීමට මා හට හැකියාවක් නොමැති බව මම පැහැදිලිව සඳහන් කරමි. කෙසේ වෙතත්, එම චෝදනාවල බරපතළ ස්වභාවය, නිදහස අහිමි වූ පුද්ගලයන්ගේ විශේෂ අවදානම් තත්ත්වය සහ කඩිනම් පියවර නොගතහොත් අදාළ සාක්ෂි නැතිවීමට, වෙනස් කිරීමට හෝ විනාශ වීමට ඇති අවදානම සැලකිල්ලට ගත් විට, මෙම කරුණු ස්වාධීන හා හදිසි විමර්ශනයකට ලක්විය යුතු බව ගෞරවයෙන් ඉදිරිපත් කරමි.
මෙම චෝදනා සත්ය බව තහවුරු වුවහොත්, ජීවිතයට ඇති අයිතිය, වධහිංසාවෙන් සහ කෲර, අමානුෂික හෝ අවමන් සහගත සැලකීමෙන් නිදහස් වීමේ අයිතිය, රාජ්ය භාරයේ සිටින පුද්ගලයන් ආරක්ෂා කිරීමේ රාජ්ය වගකීම සහ රාජ්ය භාරයේ සිදුවන මරණ හා බරපතළ තුවාල සම්බන්ධයෙන් කඩිනම්, ඵලදායී, ස්වාධීන සහ අපක්ෂපාතී විමර්ශන පැවැත්වීමේ ජාත්යන්තර වගකීම් ඇතුළු ශ්රී ලංකාවේ ජාත්යන්තර මානව හිමිකම් බැඳීම් ක්රියාත්මක විය හැකිය.
ඒ අනුව, අධිකරණ ක්රියාවලියකින් තොරව, කෙටි ක්රියාවලියකින් හෝ අත්තනෝමතික ලෙස සිදුවන ඝාතන පිළිබඳ එක්සත් ජාතීන්ගේ විශේෂ වාර්තාකරු, වධහිංසා පිළිබඳ විශේෂ වාර්තාකරු සහ අදාළ විය හැකි අනෙකුත් විශේෂ වාර්තාකරුවන් ඇතුළු අදාළ එක්සත් ජාතීන්ගේ විශේෂ ක්රියාපටිපාටි යාන්ත්රණ, තමන් සුදුසු යැයි සලකන පියවර ගැනීම සලකා බලන ලෙස ගෞරවයෙන් ඉල්ලා සිටිමි. ඒ අතර,
• මෙම චෝදනා සම්බන්ධයෙන් ශ්රී ලංකා රජය සමඟ හදිසි සන්නිවේදනයක් පැවැත්වීම;
• මීගමුව බන්ධනාගාරයේ සිට මාරු කළ සියලුම රැඳවියන්ගේ ජීවිත, ආරක්ෂාව සහ ශාරීරික අඛණ්ඩතාව ආරක්ෂා කිරීමට වහාම පියවර ගන්නා ලෙස ඉල්ලා සිටීම;
• CCTV දර්ශන, ප්රවාහන වාර්තා, වෛද්ය වාර්තා, සිද්ධි වාර්තා, සන්නිවේදන වාර්තා, අධිකරණ වෛද්ය සාක්ෂි සහ පශ්චාත් මරණ පරීක්ෂණ වාර්තා ඇතුළු සියලු අදාළ සාක්ෂි ආරක්ෂා කරන ලෙස බලධාරීන්ගෙන් ඉල්ලා සිටීම;
• රාජ්ය භාරයේ සිදුවන සියලුම මරණ හා බරපතළ තුවාල සම්බන්ධයෙන් ජාත්යන්තර ප්රමිතීන්ට අනුකූලව කඩිනම්, ස්වාධීන, අපක්ෂපාතී සහ විනිවිදභාවයෙන් යුතු විමර්ශන සිදු කරන ලෙස ඉල්ලා සිටීම;
• තුවාල ලැබූ සියලුම රැඳවියන්ට කිසිදු වෙනස්කොට සැලකීමකින් තොරව වහාම ප්රමාණවත් වෛද්ය ප්රතිකාර ලබාදීමට ශ්රී ලංකා රජය දිරිමත් කිරීම;
• මෙම සිද්ධීන් පිළිබඳ තොරතුරු ලබාදෙන රැඳවියන්, බන්ධනාගාර නිලධාරීන්, වෛද්ය කාර්ය මණ්ඩලය, සාක්ෂිකරුවන් සහ පවුල් සාමාජිකයන්ට එරෙහි බිය ගැන්වීම් හෝ පළිගැනීම් වැළැක්වීම සඳහා ඵලදායී ආරක්ෂණ ක්රියාමාර්ග ඉල්ලා සිටීම; සහ
• තත්ත්වය අඛණ්ඩව නිරීක්ෂණය කර, අවශ්ය අවස්ථාවලදී ශ්රී ලංකා රජය සමඟ වැඩිදුර සම්බන්ධ වෙමින් එරට ජාත්යන්තර මානව හිමිකම් බැඳීම් ක්රියාත්මක කිරීම ප්රවර්ධනය කිරීම.
මෙම සන්නිවේදනය යහපත් විශ්වාසයෙන් සහ මහජන යහපත වෙනුවෙන් පමණක් ඉදිරිපත් කරනු ලැබේ. මෙහි අරමුණ ශ්රී ලංකාවේ ස්වෛරීභාවය අභියෝගයට ලක් කිරීම හෝ එරට දේශීය ආයතනවල කාර්යභාරයට මැදිහත් වීම නොවේ. එහි එකම අරමුණ වන්නේ ශ්රී ලංකාවේ ආණ්ඩුක්රම ව්යවස්ථාවට සහ ජාත්යන්තර මානව හිමිකම් බැඳීම්වලට අනුකූල වන පරිදි විනිවිදභාවයෙන් යුතු, නීත්යානුකූල සහ ස්වාධීන වගවීමේ ක්රියාවලිය ප්රවර්ධනය කිරීමයි.
ශ්රී ලංකාව ජාත්යන්තර සිවිල් හා දේශපාලන අයිතිවාසිකම් පිළිබඳ සම්මුතිය (ICCPR) සහ වධහිංසාවට එරෙහි සම්මුතිය (CAT) ඇතුළු ජාත්යන්තර මානව හිමිකම් ගිවිසුම් රැසක පාර්ශ්වකරුවෙකි. රාජ්ය භාරයේ සිටින පුද්ගලයන්ගේ මරණ හෝ බරපතළ අපයෝජන සම්බන්ධයෙන් විශ්වාසදායක චෝදනා ඉදිරිපත් වන විට, කාලෝචිත ජාත්යන්තර මැදිහත්වීමක් මගින් දේශීය ආයතනවලට සාක්ෂි ආරක්ෂා කිරීම, තවදුරටත් හානි වැළැක්වීම, වගවීම ප්රවර්ධනය කිරීම සහ යුක්තිය පසිඳලීම පිළිබඳ මහජන විශ්වාසය ශක්තිමත් කිරීම සඳහා සහාය විය හැකිය.
මෙම සන්නිවේදනය අතිශය හදිසි කරුණක් ලෙස සලකා, අදාළ එක්සත් ජාතීන්ගේ විශේෂ ක්රියාපටිපාටි යාන්ත්රණවල බලතල යටතේ සුදුසු යැයි සලකන පියවර කඩිනමින් ගන්නා ලෙස ගෞරවයෙන් ඉල්ලා සිටිමි.

Subject: Request for Urgent Attention by United Nations Human Rights Mechanisms Regarding Alleged Human Rights Violations Following the Negombo Prison Incident – Sri Lanka
Dear Madam/Sir,
I respectfully write to request the urgent attention of the relevant United Nations human rights mechanisms concerning serious allegations arising from the recent violent incident at Negombo Prison in Sri Lanka and subsequent events reportedly occurring during the transfer of inmates to Welikada Prison.
On 6 July 2026, I submitted a formal complaint to the Human Rights Commission of Sri Lanka requesting an urgent, independent, impartial and transparent investigation into the Negombo Prison incident, which, according to publicly available reports, resulted in multiple deaths and serious injuries among persons deprived of their liberty and prison officers.
While I fully acknowledge that the primary responsibility for investigating these matters rests with the Government of Sri Lanka through its competent domestic institutions, I consider it necessary to bring these developments to the attention of the United Nations due to subsequent reports alleging further serious violations involving persons in State custody.
According to information received this evening from the Committee for Protecting Rights of Prisoners, twenty-one inmates transferred from Negombo Prison to Welikada Prison were allegedly subjected to severe physical assaults while being transported under official custody. The information further alleges that the inmates arrived at the Welikada Prison Hospital with extensive injuries, that at least one inmate sustained a gunshot wound, and that one of the injured prisoners subsequently died.
Most concerning are allegations suggesting that there may have been attempts to conceal the circumstances surrounding the reported death by presenting it as a suicide. I wish to make clear that I am not in a position to independently verify these allegations. Nevertheless, given their gravity, the particular vulnerability of persons deprived of their liberty, and the potential risk that relevant evidence could be lost, altered or destroyed if timely action is not taken, I respectfully submit that these allegations warrant urgent independent scrutiny.
If substantiated, these allegations may engage Sri Lanka’s obligations under international human rights law, including the right to life, the prohibition of torture and other cruel, inhuman or degrading treatment or punishment, the duty to protect persons deprived of their liberty, and the obligation to conduct prompt, effective, independent and impartial investigations into deaths and serious injuries occurring in State custody.
In light of the foregoing, I respectfully request that the relevant United Nations Special Procedures—including, where appropriate, the Special Rapporteur on extrajudicial, summary or arbitrary executions, the Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment, and any other mandate holders whose mandates may be engaged—consider taking such action as they deem appropriate, including:
* Communicating urgently with the Government of Sri Lanka regarding these allegations;
* Requesting immediate measures to protect the lives, safety and physical integrity of all inmates transferred from Negombo Prison;
* Calling upon the authorities to preserve all relevant evidence, including CCTV recordings, transport records, medical records, incident reports, communication records, forensic evidence and post-mortem documentation;
* Requesting that any deaths or serious injuries occurring in State custody be subjected to prompt, independent, impartial and transparent investigations consistent with international standards;
* Encouraging the Government to ensure that all injured prisoners receive immediate and adequate medical treatment without discrimination or delay;
* Requesting effective safeguards against intimidation or reprisals directed towards inmates, prison officers, medical personnel, witnesses or family members who may provide information concerning these events; and
* Monitoring developments and, where appropriate, engaging further with the Government of Sri Lanka to promote compliance with its international human rights obligations.
This communication is submitted in good faith and solely in the public interest. It is not intended to undermine the sovereignty of Sri Lanka or to interfere with its domestic institutions. Rather, it seeks to encourage transparent, lawful and independent accountability processes consistent with Sri Lanka’s Constitution and its obligations under international human rights law.
Sri Lanka is a State Party to numerous international human rights treaties, including the International Covenant on Civil and Political Rights and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. Where credible allegations concern deaths or serious abuse of persons held entirely under State custody, timely international engagement may assist domestic institutions in protecting evidence, preventing further harm, promoting accountability and reinforcing public confidence in the administration of justice.
I respectfully request that this communication be treated as a matter of urgency and that any action considered appropriate within the mandates of the relevant United Nations Special Procedures be taken without delay.
I would also be grateful if this communication could be brought to the attention of any other relevant United Nations mandate holders or offices whose engagement may be considered appropriate.
